Class Connect Terms of Use

Welcome to Class Connect ('Class Connect', 'we', 'us', or 'our'), a platform that connects students and parents with tuition centres in Singapore. These Terms of Use ('Terms') govern your access to and use of the Class Connect website, mobile application, and any other related services (collectively, the 'Platform'). Please read these Terms carefully before using the Platform. By accessing or using the Platform, you agree to be bound by these Terms. If you disagree with any part of the Terms, you are required to stop and discontinue your usage of the Platform.

1. Using Class Connect

• Account Creation: You may be required to create an account to access certain features of the Platform. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

2. Content

• Generated Content: The Platform allows Partner Centres to create and manage their own class listings and other content ('Content'). Class Connect does not control or endorse any Content, and we are not responsible for the accuracy, completeness, or legality of any Content. Partner Centres are solely responsible for ensuring the accuracy and completeness of their Content. Class Connect is not liable for any errors, omissions, or inaccuracies in any Content. The Content provided is for general information only and should not be relied upon as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information.
• Third-Party Content: The Platform may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or availability of any third-party websites or resources. Your use of any third-party websites or resources is at your own risk.
• Class Connect Content: All content on the Platform that is not Content, including but not limited to text, graphics, logos, images, audio clips, video clips, and software, is the property of Class Connect or its licensors and is protected by copyright and other intellectual property laws. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Class Connect Content without our prior written consent.

3. Conduct

You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your account or password, including the content of your transmissions through the Platform. By way of example, and not as a limitation, you agree not to:

• Use the Platform in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).
• Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
• Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
• Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
• Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
• Restrict or inhibit any other user from using and enjoying the Platform.
• Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
• Create a false identity for the purpose of misleading others.
• Use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of information of the Platform or any portion thereof.
• Use the Platform in any manner that could damage, disable, overburden, or impair Class Connect’s servers or networks, or interfere with any other party's use and enjoyment of the Platform.
• Attempt to gain unauthorized access to the Platform, other accounts, computer systems or networks connected to Class Connect, through password mining, hacking or any other means.
• Obtain or attempt to obtain any materials or information through any means not intentionally made available through the Platform.

4. Censorship

You acknowledge that Class Connect does not pre-screen Content, but that Class Connect and its designees shall have the right (but not the obligation) in their sole discretion to refuse, edit, move or remove any Content that is available via the Platform. You agree that Class Connect has the right to remove any Content that violates these Terms or is otherwise objectionable in Class Connect’s sole discretion. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.

You acknowledge and agree that Class Connect may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms; (c) respond to claims that any Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of Class Connect, its users and the public.

5. Advertisements and Promotions

Class Connect reserves the right to display advertisements and promotions on the Platform. You acknowledge and agree that Class Connect is not responsible for the content of any such advertisements and promotions, or for any transactions that may occur between you and any advertiser or sponsor.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CLASS CONNECT DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLASS CONNECT WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES, WHETHER ARISING UNDER CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF CLASS CONNECT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

You agree to indemnify, defend, and hold harmless Class Connect, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, demands, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third-party right.

9. Governing Law and Dispute Resolution

These Terms and your use of the Platform will be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms or your use of the Platform will be resolved exclusively by the courts of Singapore.

10. Termination

We may terminate your access to the Platform, with or without cause, and with or without notice, at any time.

11. Entire Agreement

These Terms constitute the entire agreement between you and Class Connect relating to your access to and use of the Platform and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Class Connect.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck and the remaining provisions will be enforced.

13. Waiver

No waiver of any term of these Terms will be deemed a further or continuing waiver of such term or any other term, and Class Connect's failure to assert any right or provision under these Terms will not constitute a waiver of such right or provision.
